Concierge Transportation Services Agreement & Terms of Service

THE BALLOTT BOX LLC
d/b/a THE BALLOTT EXPRESS

Effective Date: Service Date July 28, 2026

This Concierge Transportation Services Agreement ("Agreement") is entered into between The Ballott Box LLC, doing business as The Ballott Express ("Company"), owned and operated by James Ballott II, and the client identified in the reservation ("Client").

By booking, paying for, or using the Company's services, the Client acknowledges that they have read, understood, and agreed to all of the following terms.

1. Nature of Services

The Ballott Express provides private concierge transportation and related concierge services. The Company agrees only to provide transportation and concierge services as described in the reservation.

No guarantee is made regarding travel times, traffic conditions, weather conditions, road closures, or events beyond the Company's control.

2. Assumption of Risk

The Client voluntarily assumes all risks associated with riding in a motor vehicle and using concierge transportation services.

The Client also accepts responsibility for informing all passengers using the reservation that they are subject to these Terms of Service.

3. Release and Waiver of Liability

To the fullest extent permitted by applicable law, the Client, on behalf of themselves and all passengers, voluntarily releases and forever discharges:

  • The Ballott Box LLC
  • The Ballott Express
  • James Ballott II
  • All employees, contractors, agents, representatives, successors, and assigns

from any and all claims, demands, lawsuits, liabilities, damages, losses, costs, attorney fees, or expenses arising out of or relating to:

  • Personal injury
  • Bodily injury
  • Illness
  • Emotional distress
  • Death
  • Property damage
  • Lost wages
  • Lost business opportunities
  • Medical expenses
  • Hospital bills
  • Disability
  • Pain and suffering
  • Transportation delays
  • Acts of third parties
  • Acts of passengers
  • Criminal acts committed by others
  • Accidents beyond the Company's reasonable control

except where prohibited by applicable law.

4. Passenger Responsibility

The Client accepts full responsibility for the conduct, safety, and actions of every passenger included in the reservation.

The Company assumes no responsibility for injuries resulting from:

  • Failure to wear a seatbelt.
  • Entering or exiting the vehicle.
  • Passenger misconduct.
  • Horseplay.
  • Alcohol or drug impairment.
  • Illegal conduct.
  • Failure to follow driver instructions.

5. Medical Emergencies

The Company is not a medical transportation provider.

Should a medical emergency occur, the Company may contact emergency services if reasonably necessary but assumes no responsibility for medical treatment, medical expenses, or the outcome of any medical emergency.

6. No Liability for Third Parties

The Company shall not be liable for the acts or omissions of: Other motorists, government agencies, hotels, restaurants, event venues, airlines, contractors, ride-share services, security personnel, valet companies, or any third party connected with the Client's itinerary.

7. Indemnification

The Client agrees to defend, indemnify, and hold harmless The Ballott Box LLC, The Ballott Express, and James Ballott II from and against any claims, lawsuits, damages, judgments, settlements, attorney fees, court costs, or expenses arising out of:

  • The Client's conduct;
  • The conduct of any passenger;
  • Violation of these Terms;
  • Damage caused by passengers;
  • Any lawsuit brought by a passenger or guest associated with the Client.

8. Property Damage

The Client is financially responsible for any damage caused to Company vehicles or property by the Client or any passenger, including but not limited to: Vomit cleanup, burns, broken windows, torn upholstery, excessive cleaning, smoking damage, or intentional damage. Repair and cleaning costs may be charged to the payment method on file.

9. Personal Property

The Company is not responsible for lost, stolen, or damaged personal belongings.

10. Alcohol, Drugs, and Illegal Activity

The Company reserves the right to immediately terminate service without refund if any passenger: Uses illegal drugs; possesses illegal substances; becomes violent; threatens the driver; commits a crime; endangers others; or damages Company property. Law enforcement may be contacted when appropriate.

11. Cancellation of Service

The Company may refuse or terminate service whenever necessary to protect the safety of the driver, passengers, or the public.

12. Limitation of Liability

To the fullest extent permitted by law, the Company's maximum liability for any claim arising out of this Agreement shall not exceed the amount actually paid by the Client for the specific reservation giving rise to the claim. The Company shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages.

13. Insurance

The Company maintains insurance as required by applicable law. Nothing contained in this Agreement shall be interpreted as expanding the Company's legal obligations beyond those required by law or by applicable insurance policies.

14. Governing Law

This Agreement shall be governed by the laws of the State of Oklahoma. Any legal proceeding shall be brought exclusively in a court of competent jurisdiction located in Tulsa County, Oklahoma, unless otherwise required by law.

15. Severability

If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

This Agreement constitutes the complete understanding between the parties and supersedes all prior discussions or representations.

17. Electronic Acceptance

By signing electronically, booking online, paying an invoice, or using Company services, the Client acknowledges that they have read and agree to these Terms and that this electronic acceptance shall have the same force and effect as a handwritten signature.

CLIENT ACKNOWLEDGMENT

I certify that:

  • I have read this Agreement.
  • I understand these Terms.
  • I voluntarily agree to them.
  • I have authority to agree on behalf of every passenger included in my reservation.

Cancellation Policy

Effective Date: Service Date July 28, 2026

By confirming and reserving services with THE BALLOTT EXPRESS, the client agrees to the following cancellation terms:

Last-Minute Cancellations & No-Shows

Cancellations within 24 hours of scheduled pickup, or failures to appear ("No-Show"), result in a fee of one (1) hour of service at $120.00, plus the $35.00 non-refundable reservation fee.

Policy Scope

This policy applies to all bookings, including hourly, airport, and priority transport, to cover resource allocation and lost availability.

I confirm I have read, understand, and agree to the 24-hour notice policy and automatic billing of cancellation fees.
